GENERAL INFORMATION FOR ALL USERS

The following terms and conditions (the "Terms and Conditions") govern your ("You") access to and use of the website located at www.WorldJobz.com (together with all content "Content" and services "Services" thereon, and any successors to such site, the "Site"). The Site is operated by Maan Jee AB, ("MJ" or "We"). BY USING THE SITE, YOU ACCEPT AND AGREE TO THESE TERMS AND CONDITIONS AS APPLIED TO YOUR ACCESS TO AND USE OF THE SITE. If you do not agree to these Terms and Conditions, you may not access or otherwise use the Site.

If you are a Job Seeker using the Site, any terms in these Terms and Conditions that are expressed to apply solely to Employers / Recruiters do not apply to you.

If you are an Employer / Recruiter using the Site, any terms in these Terms and Conditions that are expressed to apply solely to Job Seeker do not apply to you.

  1. BINDING AGREEMENT:
    These Terms and Conditions form a binding agreement (the "Agreement") between You and MJ.
    This Agreement, as amended from time to time, including the terms and conditions of use, constitute the entire agreement between the parties, and all prior or other agreements or representations, written or oral, are superseded.
    1. CERTAIN DEFINITIONS
      The following definitions apply to this Agreement:
      1. "WorldJobz website" or the "Site" means www.WorldJobz.com in its entirety including its Content and Services as applicable in the context.
      2. "Content" means all Text, Graphics, Design and Programming used on the Site.
      3. "Design" means the colour combinations and the page layout of the Site.
      4. "Programming" means both client-side code (HTML, JavaScript, etc.) and server-side code (programming languages, databases, etc.) used on the Site.
      5. "Document" means any posting to the Site by a User, including details of a job or CV.
      6. "Employer" means a person or entity that is accessing the Site to post a job or for any reason related to the purpose of seeking candidates for employment.
      7. "Graphics" means all logos, buttons, and other graphical elements on the Site, with the exception of paid advertising banners.
      8. "Job Seeker" means a User who is accessing the Site to search for a job.
      9. "Services" means any services provided on the Site by MJ or its agents.
      10. "Text" means all text on every page of the Site, whether editorial, navigational, or instructional.
      11. "User" refers to any individual or entity that uses any aspect of the Site.
      12. "You" and "you" means the person who (or the entity on behalf of whom you are acting) that is agreeing to these Terms and Conditions.
    2. We may change these Terms and Conditions of this Agreement from time to time and at any time without notice to you, by posting such changes on the Site. We reserve the right, for any reason, in our sole discretion, to terminate, change, suspend or discontinue any aspect of the Site, including, but not limited to, content, features or hours of availability. By using the Site following any modifications to the Terms and Conditions, you agree to be bound by any such modifications to the Terms and Conditions of this Agreement. We may also impose limits on certain features of the Site or restrict your access to part or all of the Site without notice or penalty.
    3. Usage of Site including registering, searching or posting jobs, and searching or posting resumes, implies acceptance of these terms and conditions.
  2. LIABILITY:
    We assume no liability or responsibility for the content submitted by the users of the Site. MJ is not responsible for the accuracy of posted jobs and or posted resumes.
    1. Advertiser and User of the Site retain the sole responsibility for content of adverts and resumes and all applicable laws, regulations and standards.
    2. All employers, recruiters, agencies and job seekers posting adverts or resumes on the Site must adhere to commonsense business ethics. This includes: No obscene, discriminating, libelous, defamatory, sexually explicit, misleading or false information.
    3. MJ is not a placement agency or recruiting firm and we do not guarantee that jobs or resumes posted will result in candidates being contacted or hired or jobs filled.
    4. All contents on the Site (all Text, Graphics, Design and Programming), including the job and resume database, are the sole property of MJ.
    5. The unauthorized use of spiders, robots, or any other such device to navigate or search any area of the Site is prohibited.
    6. MJ reserves the right to deny or suspend the services of this site to any individual for any reason.
    7. MJ does not represent or warrant the truthfulness, accuracy or reliability of any material posted by others on or through the Site, nor does MJ endorse any opinions expressed by Users or others. Users acknowledge that any reliance on material posted by others will be at their own risk. Any content placed on any discussion area by Users are the views of the User posting the statement, and do not represent the views of MJ.
  3. LIMITATION OF LIABILITY:
    IN NO EVENT SHALL MJ OR ITS AFFILIATES OR ANY OF THE DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS OF THE FOREGOING BE LIABLE FOR ANY INDIRECT, DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF, OR THE INABILITY TO USE, THE SITE, INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE, OR ANTICIPATED PROFITS OR LOST BUSINESS OR LOST SALES, EVEN IF MJ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO CERTAIN USERS. IN NO EVENT SHALL MJ BE LIABLE FOR OR IN CONNECTION WITH ANY CONTENT POSTED, TRANSMITTED, EXCHANGED OR RECEIVED BY OR ON BEHALF OF ANY USER OR OTHER PERSON ON OR THROUGH THE SITE.
  4. COPYRIGHT:
    All Site Content, including logos, text, design, graphics, software, animation, Search Engine and Databases are the sole property of MJ, and are protected by Swedish and International copyright laws. You may not reproduce, modify, display, distribute or sell the content. This also applies to HTML code used to generate Web pages on MJ.
  5. DISCLAIMER OF WARRANTIES:
    THE SITE, INCLUDING, WITHOUT LIMITATION, ALL CONTENT, SERVICES, FUNCTIONS AND MATERIALS THEREON, IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY CONCERNING THE AVAILABILITY, ACCURACY OR USEFULNESS THEREOF, AND ANY WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. MJ DOES NOT WARRANT THAT THE SITE (INCLUDING, WITHOUT LIMITATION, THE CONTENT, SERVICES AND MATERIALS THEREIN) WILL BE TIMELY, SECURE, UNINTERRUPTED OR ERROR FREE, OR THAT DEFECTS WILL BE CORRECTED. MJ MAKES NO WARRANTY THAT THE SITE WILL MEET USERS' REQUIREMENTS. NO ADVICE, RESULTS OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MJ OR THROUGH THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. IF YOU ARE DISSATISFIED WITH THE SITE OR ANY CONTENT OR FUNCTION THEREON, YOUR SOLE REMEDY IS TO DISCONTINUE USING THE SITE.
  6. PRIVACY:
    The Privacy Policy posted on the Site is incorporated into this Agreement by this reference.
  7. LINKS TO OTHER SITES:
    You acknowledge and agree that we have no responsibility for the accuracy or availability of information provided by websites to which you may link from the Site ("Linked Sites"). Links to Linked Sites are provided as a convenience to you, and do not constitute an endorsement by or association with MJ of such sites or the content, products, advertising or other materials presented on such sites. MJ does not author, edit, or monitor these Linked Sites. You acknowledge and agree that MJ is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on such Linked Sites.
  8. ADVERTISING:
    You acknowledge and agree that we have no responsibility for the content of advertising appearing on the Site and in Site's e-newsletters. The placement of such advertisements does not constitute a recommendation or endorsement by us of the advertiser's products and each advertiser is solely responsible for any representations made in connection with its advertisement.
  9. GOVERNING LAW AND JURISDICTION:
    We do not represent that materials on the Site are appropriate or available for use in other locations. Persons who choose to access this Site from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable. The Terms and Conditions and the relationship between you and MJ shall be governed by the laws of the Sweden, without regard to its conflict of law provisions. You and MJ agree that any cause of action that may arise under this Agreement shall be commenced and be heard in the appropriate court in the Sweden, County of Skåne. You and MJ each agree to submit to the personal and exclusive jurisdiction of the courts located within County of Skåne in the Sweden. The failure of MJ to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action by you arising out of or related to use of the Services or the Terms and Conditions must be filed within one (1) month after such claim or cause of action arose or be forever barred.

EMPLOYERS, RECRUITERS AND AGENCIES

  1. JOB POSTING POLICIES:
    1. Each job posting is for a unique position. Job titles listing multiple positions (such as "Managers or Engineers") are not permitted. MJ reserves the right to alter job postings that do not comply with the 'single position' posting policy or any other violation of our posting policies.
    2. Each job posting by the Advertiser to the Site via the Site’s Posting Service will remain advertised on the Site for up to 60 consecutive days from the Launch Date (Publish Date).
    3. Each job posting to the Site will first appear on the Site from the Launch Date set forth by the Advertiser during the electronic submission of such job posting by the Advertiser to the Posting Service.
    4. The Advertiser will be liable for the fees payable to the MJ for the Services in accordance with this Agreement and the Advertiser will pay the Fees to the MJ in advance of posting Advertising Content unless otherwise agreed.
    5. The MJ will not be liable or responsible for checking the Advertising Content to ensure it is correct, accurate, and complete or that it does not contain any errors. The MJ will not be liable for any errors, mistakes, or omissions made during the electronic submission, processing and/or posting the Advertising Content to the Site. MJ does not offer the Advertiser the facility to edit its advertisements already on the Site via the Posting Service.
    6. The MJ may delete any Advertising Content from the Site or refuse to post any Advertising Content to the Site if the content of such Advertising Content is not consistent with these Terms & Conditions.
    7. MJ allows users to search for and access the content of the Site (including the Advertising Content advertised on the Site).
    8. MJ does NOT guarantee that the Services will lead to a successful campaign for the Advertiser.
    9. Submitting or posting hyperlinks or HTML code is not acceptable except in data fields that specifically request such data.
  2. RESUME SEARCH POLICIES:
    1. All subscribers to the Resume Search must be bonafide Employers and/or Recruiters. The resume database is to be accessed and used solely by the subscriber, for internal use only, for the purpose of recruiting candidates for open job opportunities. You may not distribute, sell or disclose any resumes to third parties. You may not provide your username and password or otherwise permit access to the resume database to any other party. You may view resume details, one at a time, up to a maximum of 250 resumes per day, 1,500 per month and 10,000 per year.
    2. Candidates post their resumes solely to receive information for genuine job opportunities. Their privacy must be honored and respected at all times. You may only contact candidates for specific legitimate job openings. You may not copy resumes for the purpose of populating a resume database or mailing list. You may not contact candidates for any other purpose such as sending unsolicited e-mails offering products, services or multi-level-marketing schemes.
    3. MJ cannot guarantee the number of resumes available on the database on any given day.
    4. Resumes are only made available to employers, recruiters and agencies for the purpose of securing suitable employment. MJ makes no guarantee whatsoever to the availability of members. Additionally, there is absolutely no guarantee the quantity or quality of the resumes' available and no refunds are available in respect of an unsatisfactory search of the MJ's resumes database.
    5. We do not allow access to the resume database to any other job board, nor to any persons representing or acting as agents for any other job board. Unauthorized copying of job postings to post on other job boards is not permitted. Copying resumes or e-mail addresses to solicit traffic to other job boards is strictly prohibited and will result in appropriate legal action. Only bona-fide candidates can apply to the positions on our board. We do not allow other job boards or recruiters to waste the time of our customers by attempting to use this board to solicit their services. Any entity that violates the provisions contained in this paragraph agrees to pay MJ a fine in the amount of € 50,000 per occurrence, plus reasonable attorneys' fees and costs, within five (5) days after receipt of written notice from MJ or its representative(s) describing the violation in question.
  3. SUBMITTED MATERIAL:
    Any information or material that you submit or send to MJ or otherwise make available on or through the Site ("Your Material") will be deemed not to be confidential or secret. By submitting or otherwise making Your Material available on the Site, you:
    1. Agree that Your Material will not be treated as confidential or proprietary.
    2. Represent and warrant that Your Material:
      1. Is original to you and that no other party has any rights to the material;
      2. Does not contain any content that is unlawful, threatening, harassing, profane, torturous, defamatory, vulgar, obscene, libelous, deceptive, fraudulent, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), invasive of another's privacy, or hateful;
    3. Does not contain a virus or other harmful component; and
      1. Does not contain, unless the specific Service allows, any advertising of any kind, or false or misleading indications of origin or statements of fact.
    4. Grant MJ the royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully sub-licensable right and license to use, reproduce, modify, edit, adapt, publish, translate, create derivative works from, distribute, perform and display Your Material (in whole or part) worldwide and/or to incorporate it in other works
    5. in any form, media, or technology now known or later developed. You also warrant that any 'moral rights' in Your Material have been waived.
  4. FEES:
    The fees for the Services provided under this agreement will be quoted to the Employers, Recruiters and Agencies ("Advertiser") on the Posting Service at the time. The Advertiser selects the Services it wishes to obtain under this agreement. After acceptance has occurred of these terms and conditions, the fees will be confirmed to the Advertiser at the time the Advertiser provides its credit card or other payment card details via the online secure server payment facility.
    1. The Advertiser will pay the relevant fees to the MJ at the time it selects the Services via the posting service. Unless otherwise agreed by MJ, the
    2. Advertiser will pay the fees due under this Agreement to MJ by credit card or other payment card. Payment will be deemed to have been made by the
    3. Advertiser to MJ at the time the Advertiser's credit card or other payment card is charged and MJ is in receipt of cleared funds from the credit card or other payment card in MJ’s bank account.
    4. Unless otherwise set out in this agreement, the Advertiser will not be entitled to any refund, credit, lien or set-off of any kind from the time the relevant fee is paid. There is strict no refund policy unless specifically agreed by management of MJ.
    5. All Fees and any other additional fees or charges described in this Agreement or set out on the Site are in Euro (EUR) and net of Value Added Tax ("VAT"). VAT is due and payable on all fees for EU entities.
    6. In the event that MJ (or its systems) provides an incorrect quote of the Fees (whether due to an error or otherwise) and has deducted such incorrect amount of Fees from the Advertiser's credit or other payment card, as applicable, the Advertiser will pay MJ the correct amount due to MJ by credit or other payment card if MJ contacts the Advertiser and provides details of the incorrect quote. Or, if applicable, MJ will refund any overcharged fees to the advertiser due to such incorrect Fees being previously charged to the Advertiser.
    7. MJ reserves the right to revise job posting fees, resume search subscription fees and other product charges without prior notice.
  5. CREDIT CARD SECURITY:
    MJ uses the highest level of encryption to ensure the security and safety of your credit card information. Your credit card information is not saved in our database. THIS IS FOR YOUR PROTECTION.
  6. BANKRUPTCY:
    You will immediately notify MJ of any bankruptcy, receivership, insolvency or similar action or proceeding initiated by or against you or any of your principals. You will include MJ on the list and matrix of creditors as filed with the Bankruptcy Court, whether or not a claim may exist at the time of filing. Failure to comply with either of these requirements will be cause for immediate termination or any other action available to MJ under applicable Rules or Law.
  7. SEVER ABILITY AND WAIVER:
    If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, unenforceable, or illegal, the invalidity of that provision will not affect any of the remaining provisions and this Agreement will be construed as if the invalid, unenforceable or illegal provision is not contained in the Agreement. Neither the failure nor delay by MJ to exercise, or partial exercise of, any right under this Agreement will operate as a waiver or estoppel of such right, nor shall it amend this Agreement. The waiving party must sign all waivers.
  8. INDEMNITY:
    You agree to defend, indemnify and hold MJ, its directors, officers, employees, agents and affiliates harmless from any and all claims, liabilities, costs and expenses, including reasonable attorneys' fees, arising in any way from your use of the Site or the placement or transmission of Your Material on or through the Site by you.
